Terms of Service

AI Royal Portrait (the “Service”) is operated by BookAI Studio, a DBA of BrightSpan Holdings LLC (“BookAI Studio”, “we”, “us”, or “our”). By accessing or using the Service at any URL we operate, you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, please do not use the Service.

You must be at least 18 years old (or the age of digital consent in your jurisdiction) to use the Service. By using the Service you represent and warrant that you meet this requirement and that you have the legal capacity to enter into a binding agreement.

To use most features you must create an account. You agree to provide accurate, current information and to keep your login credentials confidential. You are responsible for all activity that occurs under your account. Notify us immediately at admin@bookaistudio if you believe your account has been compromised.

The Service uses a credit system. Credits may be earned (e.g. signup bonuses) or purchased through Stripe-powered payment links. All sales are subject to our Refund Policy, which is incorporated by reference into these Terms. Prices and available credit packages are shown on the Pricing page and may change at any time.

Each virtual try-on generation consumes a fixed number of credits. Credits have no cash value and are non-transferable except as required by law.

You agree NOT to use the Service to:

• Generate content that is unlawful, defamatory, harassing, or hateful.
• Create non-consensual intimate imagery of any person.
• Depict, dress, or alter images of minors in any sexual or suggestive context.
• Infringe the intellectual property, privacy, or publicity rights of any third party.
• Attempt to reverse-engineer, resell, or scrape the Service.
• Circumvent rate limits, payments, or security measures.

We may suspend or terminate any account that violates this section, with or without prior notice.

You retain all rights to the photos and prompts you upload (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to use, process, transmit, and store Your Content solely to operate the Service for you. We do not sell or use Your Content to train third-party models.

The Service, including its design, code, models, branding, and generated outputs (excluding Your Content), is owned by BookAI Studio and protected by intellectual-property laws. You may not copy, modify, or distribute the Service without our written permission.

Outputs from our AI models are probabilistic. We do not guarantee that any generated image will be accurate, suitable for a particular purpose, or free from artifacts. You are responsible for reviewing outputs before sharing or using them commercially.

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay fees, or pose a security or legal risk. Upon termination, unused purchased credits are handled per our Refund Policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOOKAI STUDIO AND ITS PARENT BRIGHTSPAN HOLDINGS LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) ONE HUNDRED US DOLLARS.

You agree to defend, indemnify, and hold harmless BookAI Studio, its parent company BrightSpan Holdings LLC, and their respective officers, directors, and employees from any third-party claim arising out of your use of the Service or violation of these Terms.

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

We may update these Terms from time to time. If we make material changes, we will post a notice on the Service or email you at the address on your account. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
